CREATOR AGREEMENT

This Creator Agreement ("Agreement") is a binding contract between you ("Creator", "you", "your") and StarFanAI ("Platform", "we", "us", "our"). By creating a creator account or uploading content, you agree to be bound by this Agreement.

1.1. This Agreement grants non-exclusive rights to host and distribute your content.

1.2. You retain all ownership rights to your content.

1.3. You may upload the same content to other platforms (subject to other platforms' terms).

1.4. You grant Platform a non-exclusive, worldwide, royalty-free license to:

- Host, store, and display your content

- Transmit and distribute your content to authorized users

- Create thumbnails and previews

- Use content for Platform operations

2.1. Platform does not guarantee any minimum income, earnings, or revenue.

2.2. Earnings depend on various factors including:

- User engagement and subscriptions

- Content quality and appeal

- Market conditions

- Platform traffic

- Competition

2.3. Platform is not liable for:

- Earnings fluctuations

- Low or zero earnings

- Loss of subscribers

- Changes in Platform policies affecting earnings

3.1. Platform may terminate your creator account at any time, with or without cause, with or without notice.

3.2. Grounds for termination include but are not limited to:

- Violation of Terms of Service

- Violation of Acceptable Use Policy

- Violation of Content Policy

- Illegal activity

- Fraud or abuse

- Chargeback fraud

- Copyright infringement

- Any other reason Platform deems necessary

3.3. Upon termination:

- Your account will be suspended or deleted

- Your content may be removed

- Your earnings may be frozen

- You may lose access to all Platform features

3.4. Platform is not liable for losses resulting from account termination.

4.1. You must comply with all applicable laws, including:

- Laws in your country of residence

- Laws in Sweden (Platform jurisdiction)

- Laws in all jurisdictions where your content may be accessed

- International child protection laws

- Copyright laws

- Privacy laws

- Tax laws

4.2. You are solely responsible for legal compliance.

4.3. Platform is not responsible for your legal violations.

5.1. You are solely responsible for all taxes in your country of residence.

5.2. Platform does not withhold taxes unless required by law.

5.3. Platform may provide tax documentation upon request.

5.4. You must:

- Report all earnings to tax authorities

- Pay all applicable taxes

- Comply with tax laws in your jurisdiction

5.5. Platform is not responsible for:

- Your tax obligations

- Tax penalties or interest

- Tax compliance issues

6.1. Payouts are processed only after:

- Completed transactions (no chargebacks or disputes)

- Deduction of Platform fees (20%)

- Deduction of payout fees

- No active fraud investigations

- Minimum threshold reached ($50)

6.2. Platform may freeze payouts if:

- Fraud is suspected

- Chargebacks occur

- Legal issues arise

- Account is under investigation

6.3. Platform is not liable for:

- Delayed payouts due to payment processor issues

- Failed payouts due to incorrect wallet or bank details

- Payout processing errors by third parties

7.1. You are FULLY responsible for all content you upload.

7.2. Platform owner is NEVER liable for:

- Content you upload

- Legal violations committed by you

- Copyright infringement by you

- Privacy violations by you

- Any claims arising from your content

7.3. You agree to indemnify and hold harmless Platform from:

- All claims arising from your content

- All legal costs and damages

- All liabilities related to your content

8.1. Platform takes a 20% fee on all transactions.

8.2. Fees are deducted before payout calculation.

8.3. Fee structure may be adjusted with notice.

8.4. You agree to Platform fees as a condition of using the Platform.

9.1. Platform may remove your content at any time for:

- Violation of policies

- Legal requirements

- Platform discretion

9.2. Platform is not liable for:

- Content removal

- Loss of earnings due to removal

- Loss of subscribers due to removal

10.1. Platform may modify this Agreement at any time.

10.2. Material changes will be notified to creators.

10.3. Continued use constitutes acceptance of modified Agreement.

11.1. Any disputes shall be resolved through binding arbitration in Sweden.

11.2. You waive your right to a jury trial and class action lawsuits.

12.1. This Agreement is governed by Swedish law.

12.2. Any legal proceedings shall be subject to Swedish jurisdiction.

13.1. This Agreement, together with Terms of Service, Acceptable Use Policy, Content Policy, and other Platform policies, constitutes the entire agreement between you and Platform.

14.1. If any provision is found unenforceable, the remaining provisions shall remain in effect.

By creating a creator account or uploading content, you acknowledge that:

- You have read, understood, and agree to be bound by this Agreement

- You are fully responsible for all content you upload

- Platform owner is never liable for your content or legal violations

- You will comply with all applicable laws

- You will handle your own taxes

- Platform may terminate your account at any time

- Platform does not guarantee earnings
