By accessing or using StarFanAI ("Platform", "Service", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

StarFanAI is a user-generated content hosting platform. We provide technology and infrastructure for creators to upload, host, and distribute content, and for users to access such content. We do not create, produce, or control the content uploaded by creators.

3.1. You must be at least 18 years of age to access or use this Platform (or the age of majority in your jurisdiction). Unauthorized access by minors is strictly prohibited.

3.2. All creators must be 18+ and verified as adults.

3.3. All users must be 18+ to view, purchase, or interact with any content on the Platform.

3.4. By using the Platform, you represent and warrant that you are 18 years of age or older.

3.5. Content on this platform focuses on AI companions, emotional connection, and fantasy fulfillment. All content maintains PG-13/suggestive standards and complies with payment processor policies.

4.1. The Platform acts solely as a hosting service for user-generated content.

4.2. We are NOT responsible for any content uploaded, created, or distributed by creators or users.

4.3. Creators are solely responsible for all content they upload, including but not limited to:

- Legality of content in their jurisdiction

- Compliance with all applicable laws

- Obtaining necessary consents and permissions

- Copyright and intellectual property rights

- Age verification of all individuals depicted

4.4. We do not pre-screen, review, or monitor all content before it is uploaded or published.

4.5. We reserve the right to remove content that violates these Terms or applicable law, but we are under no obligation to do so.

5.1. The Platform does not guarantee any minimum income, earnings, or revenue for creators.

5.2. Creator earnings depend on various factors including but not limited to:

- User engagement and subscriptions

- Content quality and appeal

- Market conditions

- Platform traffic

5.3. We make no representations or warranties regarding potential earnings.

6.1. We reserve the right to suspend or terminate your account at any time, with or without notice, for:

- Violation of these Terms

- Violation of our Acceptable Use Policy

- Illegal activity

- Fraud or abuse

- Chargeback fraud

- Copyright infringement

- Any other reason we deem necessary to protect the Platform or its users

6.2. Suspended or terminated accounts may lose access to earnings, content, and data.

6.3. We are not liable for any losses resulting from account suspension or termination.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STARFANAI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

7.1. Any content uploaded, created, or distributed by users or creators

7.2. Any damages, losses, or injuries arising from use of the Platform

7.3. Loss of earnings, revenue, or business opportunities

7.4. Unauthorized access to or hacking of user accounts

7.5. Loss of data or content

7.6. Service interruptions or technical failures

7.7. Actions or omissions of third-party payment processors

7.8. Any indirect, incidental, special, consequential, or punitive damages

8.1. THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

8.2. We disclaim all warranties, including but not limited to:

- Merchantability

- Fitness for a particular purpose

- Non-infringement

- Accuracy or completeness of content

8.3. Content on this Platform is for entertainment purposes only.

9.1. All sales are final. Digital goods and services are non-refundable.

9.2. Subscriptions, tips, PPV purchases, and other transactions are final once completed.

9.3. No refunds will be provided except as required by applicable law.

9.4. Chargebacks may result in immediate account suspension.

10.1. By subscribing to a creator's content, you acknowledge and agree to recurring billing.

10.2. Subscriptions will automatically renew unless cancelled.

10.3. You are responsible for cancelling subscriptions before renewal if you no longer wish to be charged.

10.4. We are not responsible for charges you fail to cancel.

11.1. Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration.

11.2. Arbitration shall be conducted in accordance with the rules of the Arbitration Institute of the Stockholm Chamber of Commerce.

11.3. You waive your right to a jury trial and to participate in class action lawsuits.

12.1. These Terms shall be governed by and construed in accordance with the laws of Sweden.

12.2. Any legal proceedings shall be subject to the exclusive jurisdiction of Swedish courts.

13.1. We reserve the right to modify these Terms at any time.

13.2. Material changes will be notified via email or Platform notification.

13.3. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

These Terms, together with our Privacy Policy, Acceptable Use Policy, and other policies referenced herein, constitute the entire agreement between you and StarFanAI regarding your use of the Platform.
